Terms of Service

1. The service

Nudge is a macOS menu bar application that helps you reply to WhatsApp messages using AI-generated draft replies. By using Nudge or joining the waitlist at yournudge.app, you agree to these terms.

Nudge is developed and operated by Byron Voorbach ("we", "us"). The service is currently in beta.

2. Acceptable use

You agree to use Nudge only for lawful purposes and in ways that don't infringe the rights of others. You may not:

• — Use Nudge to send spam, harass others, or engage in any fraudulent activity.
• — Attempt to reverse-engineer, decompile, or circumvent any part of the app or its licensing system.
• — Use Nudge in a way that violates applicable laws or regulations.

You are responsible for the content of any messages sent using Nudge's AI drafts. Nudge generates suggestions — you decide what to send.

3. Accounts and subscriptions

Free tier access is provided without charge up to published limits (currently 5 AI-generated drafts per day). Pro subscriptions are billed monthly. You can cancel at any time; access continues until the end of the current billing period. We do not offer refunds for partial months.

We reserve the right to modify pricing with 30 days' notice to existing subscribers.

4. AI proxy service

When you request a draft reply, message context from your recent conversation is sent through our server (yournudge.app) to Anthropic's Claude API for generation. This proxy service exists to manage API access and enforce usage limits. We do not store your message content — it passes through our server and is immediately discarded.

Rate limits are enforced server-side: free tier users receive 5 AI-generated drafts per day, resetting at midnight UTC. Usage counts are tracked per email address and auto-expire after 24 hours.

5. AI-generated content

Draft replies are generated using Anthropic's Claude API based on your recent message history. These drafts are suggestions only. We make no guarantees about their accuracy, appropriateness, or suitability. Always review a draft before sending.

6. Availability

We aim to keep Nudge and its AI proxy service available and functional, but we don't guarantee uninterrupted service. We may update, suspend, or discontinue features at any time. During beta, the service may be unstable — we appreciate your patience. Service availability is not guaranteed.

7. Limitation of liability

Nudge is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service — including but not limited to messages sent using AI drafts, loss of data, or service interruptions.

Our total liability to you for any claim arising out of these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Privacy

Your use of Nudge is also governed by our Privacy Policy, which is incorporated into these terms by reference.

9. WhatsApp integration

Nudge connects to WhatsApp using an unofficial, open-source library (whatsapp-web.js). Nudge is not endorsed by, affiliated with, or sponsored by Meta Platforms, Inc. or WhatsApp LLC.

This integration may conflict with WhatsApp's Terms of Service. By using Nudge, you acknowledge this risk and accept sole responsibility for any consequences related to your WhatsApp account, including potential suspension or termination by WhatsApp.

10. Data breach notification

In the event of a data breach affecting your personal data, we will notify you in accordance with our Privacy Policy.

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated to registered users by email. Continued use of Nudge after changes take effect constitutes acceptance of the new terms.

12. Governing law

These terms are governed by the laws of the Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts of the Netherlands.
